Welcome to Popular ("we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of the Popular mobile application and related services (collectively, the "Service"). By downloading, installing, accessing, or using Popular, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
You must be at least 13 years of age (or 16 years in the European Economic Area) to use Popular. By using the Service, you represent and warrant that you meet the age requirement and have the legal capacity to enter into these Terms. If you are using Popular on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
To access certain features of Popular, you must create an account. You agree to: (a) provide accurate, current, and complete information; (b) maintain and update your information to keep it accurate; (c) maintain the security of your password and account; (d) accept responsibility for all activities under your account; and (e) notify us immediately of any unauthorized use. You are responsible for maintaining the confidentiality of your account credentials.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page, sending an email notification, or displaying an in-app notice. Your continued use of Popular after such modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.
Popular is a mobile application designed to help users improve conversation, social, and speaking skills through AI-powered role-playing, interactive lessons, gamification features, and community engagement. The Service includes features such as conversation practice, learning materials, progress tracking, achievements, leaderboards, and social interactions.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use Popular for your personal, non-commercial use. This license does not include any right to: (a) resell or commercialize the Service; (b) copy, modify, or create derivative works; (c) reverse engineer or attempt to extract source code; (d) remove any proprietary notices; or (e) use the Service for any illegal purpose.

We reserve the right to suspend or terminate your account and access to Popular at our sole discretion, without notice, for any reason, including if you violate these Terms, engage in fraudulent or illegal activity, or for any other reason we deem necessary. Upon termination, your right to use Popular will immediately cease, and we may delete your account and associated data, subject to our Privacy Policy and applicable law.
The Service, including all content, features, functionality, software, designs, text, graphics, logos, and other materials, is owned by Popular or its licensors and is protected by copyright, trademark, patent, and other intellectual property laws. You acknowledge that Popular retains all right, title, and interest in and to the Service.
Popular may offer in-app purchases, subscriptions, or premium features. All purchases are processed through third-party payment processors (e.g., Apple App Store, Google Play Store). By making a purchase, you agree to the terms and conditions of the applicable payment processor.
If you purchase a subscription, it will automatically renew at the end of each subscription period unless you cancel before the renewal date. You can manage or cancel your subscription through your device's app store settings. Subscription fees are charged in advance on a recurring basis. We reserve the right to change subscription prices with reasonable notice.
Refund requests are handled by the app store from which you made the purchase (Apple App Store or Google Play Store) in accordance with their refund policies. We do not provide direct refunds. If you believe you are entitled to a refund, please contact the app store support team.
We reserve the right to modify pricing for subscriptions and in-app purchases at any time. Price changes will not affect your current subscription period but will apply to subsequent renewals. We will provide reasonable notice of any price changes.
Popular allows you to create, upload, post, and share content, including conversation recordings, community posts, comments, and other materials ("User Content"). You retain ownership of your User Content but grant Popular a worldwide, royalty-free, non-exclusive, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with operating and promoting the Service.
You agree that your User Content will not:
We reserve the right to review, monitor, edit, or remove any User Content at our sole discretion. We are not obligated to monitor User Content but may do so to ensure compliance with these Terms and applicable laws. We may remove or disable access to any User Content that violates these Terms without prior notice.
Popular uses artificial intelligence to provide conversation role-playing and learning experiences. AI-generated content is provided for educational and practice purposes only. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content. You acknowledge that AI responses may contain errors or inaccuracies and should not be relied upon as professional advice.
All learning materials, lessons, courses, and educational content provided through Popular are for educational purposes only. While we strive to provide accurate and helpful information, we make no warranties regarding the effectiveness of our learning materials or the outcomes you may achieve.
When you use AI conversation role-playing features, your conversations may be recorded and stored to provide personalized feedback and improve your learning experience. By using these features, you consent to the recording and storage of your conversations in accordance with our Privacy Policy. You can control recording settings in your account preferences.
If you have any dispute with Popular, you agree to first contact us at contact@bepopular.com to attempt to resolve the dispute informally. We will make good faith efforts to resolve any disputes within 30 days.
If we cannot resolve a dispute informally, you and Popular agree to resolve any claims, disputes, or controversies arising out of or relating to these Terms or the Service through binding arbitration, except where prohibited by law. Arbitration will be conducted in accordance with the rules of the American Arbitration Association (AAA) or similar arbitration body, as applicable.
You and Popular agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
These Terms are governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions. For users in the European Union, applicable consumer protection laws may apply.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POPULAR AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
Popular includes gamification features such as streaks, virtual pet level-ups, leaderboards, achievements, daily challenges, levels, and pledges. These features are designed to enhance your learning experience. We reserve the right to modify, suspend, or discontinue any gamification feature at any time. Points, achievements, and rankings have no monetary value and cannot be exchanged for cash or other benefits.
Popular may offer social features, including user pairings, community forums, and daily scheduled sessions. When using these features, you agree to interact respectfully with other users. We are not responsible for the conduct of other users. You are solely responsible for your interactions with other users and any consequences thereof.
Popular tracks your progress, including conversation recordings, interaction data, lesson completion, and performance metrics. This data is used to personalize your experience and provide insights. You acknowledge that we may use anonymized and aggregated data for analytics, research, and service improvement purposes.
We strive to provide reliable service but do not guarantee that Popular will be available at all times or free from errors, interruptions, or defects. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We are not liable for any loss or damage resulting from service interruptions or unavailability.
Popular may integrate with or link to third-party services, including payment processors, analytics providers, and social media platforms. Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for the content, privacy practices, or actions of third-party services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
You agree to indemnify, defend, and hold harmless Popular and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any rights of another party.
The Service may be subject to export laws and regulations. You agree to comply with all applicable export and re-export restrictions and regulations.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Popular regarding the Service and supersede all prior agreements and understandings.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by us.
You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms or our rights and obligations without restriction.
We are not liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, pandemics, or internet or telecommunications failures.
